1.The site is within the area identified in the Local Development Framework as Metropolitan Green Belt. Policy DC45 of the LDF and Government Guidance as set out in the National Planning Policy Framework (Green Belts) states that in order to achieve the purposes of the Metropolitan Green Belt it is essential to retain and protect the existing rural character of the area so allocated and that new development will only be permitted outside the existing built up areas in the most exceptional circumstances. The development is inappropriate in principle in the Green Belt and no very special circumstances have been submitted in this case to outweigh the harm caused by reason of inappropriateness and visual harm to the character and openness of the Green Belt. The proposal is therefore contrary to Policy DC45 of the LDF Core Strategy and Development Control Policies Development Plan Document, as well as the National Planning Policy Framework.
2.The proposed development, by reason of the scale bulk and mass of the proposed dwelling, in conjunction with the limited separation from shared boundaries would represent a cramped overdevelopment of the site, at odds with prevalent local character and and the visual amenity of the locality. Accordingly the introduction of a dwelling to the site would harm the openness of the Green Belt and represent a visually intrusive form of development. The development proposals are therefore contrary to Policies DC45, DC61 of the LDF Core Strategy and Development Control Policies Development Plan Document, as well as the provisions of the National Planning Policy Framework (NPPF) and Residential Extensions and Alterations SPD.
3.The proposed dwelling would, by reason of its position and proximity to neighbouring boundaries, in conjunction with its scale, bulk and mass, result in an oppressive form of development that would appear overbearing from adjacent premises and give rise to an unacceptable loss of light therefore having an adverse effect on the living conditions of adjacent occupiers, contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD and the Residential Extensions and Alterations SPD.
4.In the absence of a legal agreement to secure contributions towards the demand for school places arising from the development, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, contrary to the provisions of Policies DC29 and DC72 of the Development Control Policies DPD and Policy 8.2 of the London Plan.
5.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of refusal and the reasons for it were given to the agent in writing 29-01-2018.
