1.i. No advertisement is to be displayed without the permission of the owner of the site or any other person with an interest in the site entitled to grant permission. ii. No advertisement shall be sited or displayed so as to:- (a) endanger persons using any highway, railway, waterway, dock, harbour or aerodrome (civil or military); (b) obscure, or hinder the ready interpretation of any traffic sign, railway signal or aid to navigation by water or air; or (c) hinder the operation of any device used for the purpose of security or surveillance or for measuring the speed of any vehicle. iii. Any advertisement displayed, and any site used for the display of advertisements, shall be maintained in a condition that does not impair the visual amenity of the site. iv. Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a condition that does not endanger the public. v. Where an advertisement is required under these Regulations to be removed, the site shall be left in a condition that does not endanger the public or impair visual amenity. Reason: These conditions are specified by the Town and Country Planning (Control of Advertisements) (England) Regulations 2007.
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
3.The degree of illumination during the day should not exceed 2500 cd/m2 and 600cd/m2 from dusk until dawn. The levels of luminance on the digital signs should be controlled by light sensors to measure the ambient brightness and dimmers to control the lighting output to within these limits. The advertisement displays shall be carried out strictly in accordance with the details so approved and shall be maintained as such thereafter. Reason:- To comply with the recommendations of the Institute of Public Lighting Engineers Technical Report No. 5 (Third Edition) in the interests of amenity.
4.The screen shall be designed so that in the event of breakdown it shall automatically power off to prevent flashing error messaged being displayed and shall be so maintained. Reason: In the interests of highway safety and amenity and to comply with the objectives of the Havering Local Plan 2016-2031, the London Plan and NPPF.
5.No special visual effects of any kind are permitted during the time that any message is displayed. The displayed image must not include animated, flashing, scrolling, intermittent or video elements. Reason: In the interests of highway safety and amenity and to comply with the objectives of the Havering Local Plan 2016-2031, the London Plan and NPPF.
6.No visual effects of any kind to be permitted to accompany the transition between any two successive messages. The replacement image must not incorporate any fading, swiping or other animated transitional method. Reason: In the interests of highway safety and amenity and to comply with the objectives of the Havering Local Plan 2016-2031, the London Plan and NPPF.
7.The minimum time between successive displayed images shall be 10 seconds. Reason: In the interests of highway safety and amenity and to comply with the objectives of the Havering Local Plan 2016-2031, the London Plan and NPPF.
8.The sequencing of messages relating to the same product is prohibited. Reason: In the interests of highway safety and amenity and to comply with the objectives of the Havering Local Plan 2016-2031, the London Plan and NPPF.
9.No advertisement to resemble traffic signals. Reason: In the interests of highway safety and amenity and to comply with the objectives of the Havering Local Plan 2016-2031, the London Plan and NPPF.
10.Temporary obstructions should be kept to a minimum and should not encroach on the clear space needed to provide safe passage for pedestrians, for servicing of the adjacent shops and housing or obstruct the flow of traffic.
11.All vehicles used during installation or maintenance should only park/stop at permitted locations and within the time periods permitted by existing on-street restrictions.
12.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with Mr Porte (Agent) by phone and e-mail. The revisions involved setting the proposal further away from the street. The amendments were subsequently submitted on 08-11-23.
