| 1. | The proposed works are considered not to materially affect the external appearance of the building and so do not consitute development as set out in S.55 (2)(a)(ii) of the Town and Country Planning Act 1990, and so do not require planning permission. |
| 2. | For any avoidance of doubt, the applicant is advised that this Certificate of Lawfulness relates only to the replacement of the existing balustrading to the balconies from metal sections with plywood infill panels painted in black to metal sections with metal infill panels painted in black. |
