The structure under consideration would meet within the definition of "building" which includes any part of a building and includes any structure or erection, but does not include mechanical plant or machinery or gates, fences, walls, or other means of enclosure.The proposed pergola would in the absence of evidence otherwise have a volume in excess of ten cubic metres and therefore does not comply with the relevant part of the Article 4 Direction and planning permission would be required. |
