1.The proposed use of the existing dwelling house as a children's care home for two children aged 10-17 with typical onsite presence of three staff if operated as described by the applicant in the supporting statement submitted dated March 2026 (in particular Paras 4.1 through 4.11) would not be materially removed from the use of the property as a single dwelling house and it is considered that there would be no material change of use having regard to the Town and Country Planning (Use Classes) Order 1987 (as amended) as the use would remain within Class C3(a) of that Order.
2.This certificate of lawfulness is issued on the basis of the use as described - "Certificate of lawfulness for proposed change of use from Use Class C3 (dwellinghouse) to Use Class C2 (children's home) for up to two children and staff". In reaching this decision particular consideration has been given to the content of the Planning Statement dated March 2026 in which the use is described as having two staff members and a manager, plus the two resident children meaning typical on-site presence of three adults and two children. It is accepted that the statement indicates situations where staffing levels may need to increase and it would be the responsibility of the applicant to ensure that the use remains lawful in those instances. The issuing of this certificate does not preclude against any action from being taken by the Council if it is later judged that a material change of use has occurred, should for example the intensity of the use go beyond what is described on the certificate issued or should the character and nature of activities divulge from the supporting information submitted and the assessment made at this time.
