1.The operations for the for replacement of roof and alterations to residential garage come within the provisions of Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015, thereby not requiring planning permission.
2.The proposed use of the residential garage is deemed acceptable and is not considered to be a material change of use from the current lawful use within Class C3(a) of that Order.
3.Development is permitted by Class A subject to the following conditions- (a) the materials used in any exterior work (other than materials used in the construction of a conservatory) shall be of a similar appearance to those used in the construction of the exterior of the existing dwellinghouse; (b) any upper-floor window located in a wall or roof slope forming a side elevation of the dwellinghouse shall be- (i) obscure-glazed, and (ii) non-opening unless the parts of the window which can be opened are more than 1.7 metres above the floor of the room in which the window is installed; and (c) where the enlarged part of the dwellinghouse has more than one storey, the roof pitch of the enlarged part shall, so far as practicable, be the same as the roof pitch of the original dwellinghouse.
4.Certificate of Lawfulness Informative Planning permission will not be required for a use of the nature described as part of the information submitted with this application operating from this address. As such, planning permission would not be required. For avoidance of doubt the applicant is advised that this certificate pertains to the following: - for the replacement of roof and alterations to residential garage to allow use for honey extraction and storage for hobby use / commercial sales with no more than two callers a day in respect to the business. However, it is worth noting that should the circumstances relating to the business alter in any respect this may change the requirements for planning permission and you should contact the Council for confirmation of these matters. The onus remains on the applicant to ensure that the development is lawful.
