1.It is considered that the measures outlined by the applicant demonstrate on balance of probability that P1836.17 was implemented prior to the expiry of the three year time limit (Condition 1). Therefore the permission remains extant, such that the development on the approved plans could be lawfully constructed - provided that the development is built in accordance with submitted plans and approved details (including those reserved by condition) and that it is constructed in compliance with the planning conditions that formed part of the planning permission.
