1. | The proposal is not within the tolerance of the provisions of Schedule 2, Part 1, Class E of the Town and Country Planning (General Permitted Development) (England) Order 2015, Section E.1
(ii) The height of the building would exceed 2.5m in the case of a building within 2m of the boundary of the curtilage of the dwellinghouse.
The proposed outbuilding would also provide all the facilities required to be used independently of the main dwelling and constitutes development, which is in excess of what would reasonably be required for a purpose incidental to the enjoyment of the dwellinghouse. It would not result in a subordinate type use. The proposal would not therefore fall within the provisions of Class E of the Town and Country Planning (General Permitted Development) Order 2015, as amended, and constitutes development for which planning permission is required. |
