1.The proposed development is considered not to be permitted development and it is therefore recommended that a Certificate of Lawfulness not be issued in this instance. Condition 4 of planning application P1419.88 stated that the garages shall only be used for the parking of private motor vehicles, caravans and / or boats and not for any other purpose including living accommodation, and not for any trade or business. A planning application for the conversion of the garage into a habitable room is required.
2.You are advised that the application property no longer meets the definition of a dwellinghouse by virtue of planning permission P1419.88 which has since been implemented. Both No. 44 and 42A Birkbeck Road, Romford are considered to be residential flats by definition with little or no permitted development rights accorded neither.
