1.The proposed development fails to accord with the provisions of Schedule 2, Part 1, Class E of the Town and Country Planning (General Permitted Development) Order 2015, and also the requirements of the DCLG Technical Guidance; 'Permitted development rights for householders' (amended 2017) in that the proposed outbuilding will consist of a bathroom and is higher than 2.5 metres within 2 metres of the boundary of the curtilage of the dwellinghouse, and therefore a Certificate of Lawfulness is denied in this instance.
