1.The proposed development is considered not to be permitted development and it is therefore recommended that a Certificate of Lawfulness not be issued in this instance. The garage has a condition preventing it from being used other than for the parking of private vehicles (planning reference: 1937.76). This planning application was for the construction of the side garage and rear extension. Condition 1 of planning application 1937.76 stated that the garage shall only be used for the parking of private motor vehicles, caravans and / or boats and not for any other purpose including living accommodation, and not for any trade or business. A planning application for the conversion of the garage into a habitable room is required.
