| 1. | The proposal does not accord with Class A as it proposes the conversion of the garage to a habitable use and the proposed rear extension is more than 4m depth for a detached house, proposing a depth of 9.3m.
Two previous approvals over the site (reference numbers: P2083.07 and P1608.04) include conditions that clearly restrict the use of the garage to not be used as a habitable room for the reason of maintaining adequate parking onsite and therefore remove permitted development rights.
Therefore, the proposed development is not considered to be in accordance with the provisions of Schedule 2, Part 1, Class A of The Town and Country Planning (General Permitted Development) (England) Order 2015 and it is therefore recommended that a Certificate of Lawfulness be refused in this instance. |
