1.The proposed use would require planning permission because it would result in the detached outbuilding within the site being used for residential accommodation by one of the intended occupiers, something which would be in breach of Condition 5 of P0912.15 which restricts the use of the outbuilding for an incidental use to the enjoyment of the dwellinghouse. The use of the outbuilding for habitable accommodation would not be considered as an incidental use, as such uses form the primary function of a dwelling house. Hence, a Certificate cannot be issued because the application building would not be lawfully used and therefore the Certificate of Lawfulness is refused.
