| 1. | The proposal fails to come within the provisions of Schedule 2, Part 1, Class A of the Town and Country Planning (General Permitted Development) (England) Order 2015, thereby planning permission is required as it goes against section A
(e) The enlarged part of the dwellinghouse would extend beyond a wall which (i) forms the principal elevation of the original dwellinghouse; and
(ii) fronts a highway and forms a side elevation of the original dwellinghouse.
The roof overhang extends beyond the front and rear building line of the dwelling.
Furthermore, the Householder Technical Guidance defines highway as 'a public right of way such as a public road, public footpath and bridleway. For the purposes of the Order it also includes unadopted streets or private ways'. |
