1.Insufficient qualitative and quantitative evidence has been provided to evidence that the existing lawful use of the premises is E(a) and furthermore that the proposed use would operate as E(b) and not a use requiring planning permission.
2.A refusal to issue a LDC is therefore not necessarily conclusive that something is not lawful: it may merely mean that, so far, insufficient evidence has been presented to satisfy the LPA that the use, operation or activity is lawful.
