| 1. | Insufficient qualitative evidence has been provided to demonstrate that the premises, the subject of this application, has been in continuous use as a separate self-contained flat for a period of four years prior to the date of the application as required by Section 191(2) of the Town and Country Planning Act 1990. |
| 2. | A refusal to issue a LDC is therefore not necessarily conclusive that something is not lawful: it may merely mean that, so far, insufficient evidence has been presented to satisfy the LPA that the use, operation or activity is lawful. |
