1.On the basis of the information provided it has not been demonstrated that the proposed use of 113 Cowper Road as assisted accommodation for up to six people with learning disabilities (Use Class C3 (b), under the terms of this application, would fall within Class C3 (b) of the Use Classes Order 1987 (as amended). Therefore due to insufficient evidence in support of the application it would constitute a material change of use within the meaning of Section 55 of the Town and Country Planning Act 1990 (as amended). As such, this will constitute development and planning permission is required.
