1.Contrary to Condition MA.2 (1)(f), the proposal fails to provide adequate natural light to all habitable rooms. In the absence of the unauthorised external alterations (new window and sun tunnels), the habitable rooms in Units 2, 5, and 7 would receive insufficient natural light.
2.The proposal fails to comply with the limitations of Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), which does not permit external physical development. The submitted plans and technical reports rely on the installation of a new window in Unit 2 and sun tunnels in Units 5 and 7. As these external works fall outside the scope of Class MA, the proposal cannot be considered permitted development.
3.The submitted Noise Impact Assessment (Syntegra, August 2025) provides insufficient detail to demonstrate that acceptable internal and external noise levels can be achieved for the intended occupiers, contrary to Condition MA.2 (1)(e). The assessment identifies the site as "High-Risk" but fails to provide a robust evaluation of the noise impacts from the attached takeaway/Eat in at 107 Victoria Road and the rear car repair workshop. Specifically, no BS 4142:2014 assessment was undertaken to account for the impacts of these commercial uses. Consequently, the Local Planning Authority is not satisfied that the intended occupiers would be protected from unacceptable noise disturbance.
