| 1. | The Council's Building Control records state that the property at No. 9 Freshfields Avenue, Upminster was built in 1937 and as such, the proposed development fails to comply with criteria AA.1 (c), as the dwellinghouse was constructed before 1st July 1948. Consequently, under the provisions of Town and Country Planning (General Permitted Development) (England) Order 2015 [as amended], the prior approval of the Local Planning Authority is refused. |
| 2. | The proposed development, by virtue of its elevated ridge height (9.73 - 9.75 metres) and additional bulk situated in close proximity (2.9 metres) to the eastern boundary, would result in a significant loss of daylight and sunlight, unacceptable overshadowing, and an unneighbourly, overbearing sense of enclosure especially to the primary ground-floor habitable room window of the adjacent single-storey dwellinghouse at No. 7 Freshfields Avenue. Furthermore, the height and massing would appear dominant and visually incongruous within this section of the street scene. The proposal is therefore contrary to Schedule 2, Part 1, Class AA (Paragraph AA.2(3)(a)) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), Policy 27 of the Havering Local Plan (2021), and Chapter 12 of the National Planning Policy Framework (2026), the prior approval of the Local Planning Authority is refused. |
| 3. | The application lacks scale section drawings or internal dimension details necessary to establish the internal floor-to-ceiling heights of the existing and proposed storeys. As a result, the applicant has failed to demonstrate that the internal floor-to-ceiling height of the proposed additional storey would not exceed that of the existing storeys. The proposal therefore fails to demonstrate compliance with the statutory limitation set out under Paragraph AA.1(j) of Schedule 2, Part 1, Class AA of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), the prior approval of the Local Planning Authority is refused. |
