1.As shown on the site photographs, the three small light level windows on the rear elevation of the building would be the sole light source to the proposed flat on Level 1 of the basement. There would be limited light to the proposed flats on Levels 1 and 2 of the basement, which would result in poor living conditions and amenity for future occupants. Consequently, under the provisions of Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2021 (as amended), the prior approval of the Local Planning Authority is refused.
2.The Sunlight and Daylight Assessment relies on the provision of the external works to provide new window openings to the proposed flats on Levels 1 and 2 of the basement, which cannot be considered as part of this application as they are not permitted development. As such, the conclusions of the Assessment can be relied upon, as there is no guarantee that these openings will be provided and the development will be carried out as per the assessment. Consequently it has not been sufficiently demonstrated that acceptable provision is made in respect of adequate natural light in all habitable rooms of the proposed flats. Consequently, under the provisions of Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2021 (as amended), the prior approval of the Local Planning Authority is refused.
