1.The proposal fails to meet the permitted development criteria of Class M of Part 3 of the GPDO 2015 in that the established lawful use is a sui generis (nail studio), not a Class A1, A2 or A5 use, nor a specified sui generis use comprising of a betting office, pay day loan shop or laundrette. There are no appropriate categories of the GPDO 2015 that allow for a change of use from a Sui Generis (nail studio) to a mixed use development comprising of an A1 shop and two flats. On this basis planning permission is required for the proposal.
