1. | The proposed development does not comply with criteria 9A of Class MA, which states that "Schedule 2 does not grant permission for, or authorise any development of, any new dwellinghouse that does not comply with the nationally described space standard issued by the Department for Communities and Local Government on 27th March 2015(1)".
The single bedroom of Flat 01 has a width of 2 metres, which doesn't meet the minimum width of at least 2.15 metres in line with the DCLG Technical Space Standards. The single bedroom of Flat 02 has a width of 2 metres, which doesn't meet the minimum width of at least 2.15 metres in line with the DCLG Technical Space Standards. Flat 03 at first and second floor levels, has a double bedroom, which is capable of double occupancy and has a gross internal floor space of 47.5 square metres, which fails to meet the minimum gross internal floor area of 58 square metres for a one bedroom, two person, two storey dwelling. Consequently, under the provisions of Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2021 (as amended), the prior approval of the Local Planning Authority is refused. |
2. | There is insufficient information regarding the impact of noise from neighbouring licensed premises and late night uses on the future occupiers of the flats. The applicant failed to demonstrate that noise from late night opening uses is likely to significantly affect the amenity of future occupiers of the flats and whether the impacts on the proposed flats within the subject building would be capable of being mitigated to the satisfaction of the Local Planning Authority and as required by MA.2. (2)(d). Consequently, under the provisions of Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2021 (as amended), the prior approval of the Local Planning Authority is refused. |
3. | The proposed development, including the waste management strategy, would not provide adequate servicing arrangements for the proposed dwellings. Consequently, under the provisions of Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2021 (as amended), the prior approval of the Local Planning Authority is refused. |
