1.The proposed development fails to demonstrate that all habitable rooms within the new dwellings would receive adequate natural light, as required by Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). In particular, one of the proposed studio flats does not include any external window or other source of natural light to its habitable space. This would result in poor living conditions for future occupiers, contrary to the requirements of Class MA and paragraph 130 of the National Planning Policy Framework (NPPF).
2.The proposal fails to meet the criteria set in paragraph MA.2. (a) under Class MA of Part 3 to Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended, with respect to transport impacts of the development, particularly to ensure safe site access. Given the location of the site, a car free scheme could be acceptable, however, there is no legal undertaking for future occupiers of the site to be excluded from applying for over-subscribed residential parking zone. In the absence of legal agreement to exempt the future occupiers of the site from residential parking zone, it is considered that the proposal would have an adverse impact upon the free flow of traffic and the safety of highway condition. In addition, it is unclear how refuse, recycling and cycle storage would be provided and the potential adverse implications this could have on the servicing of the site.
3.The submitted plans do not include section drawings or any details of internal floor-to-ceiling heights. MHCLG guidance advises that a minimum height of 2.3 metres should be achieved for at least 75% of the gross internal area to ensure acceptable living conditions. In the absence of this information, the Local Planning Authority cannot be satisfied that the proposed dwellings would comply with this requirement. The proposal therefore fails to demonstrate that it would provide adequate living conditions for future occupiers, contrary to Class MA and paragraph 130 of the NPPF.
4.The proposal fails to demonstrate that acceptable internal noise levels would be achieved for the back studio flat. The submitted noise report relies on new side windows to enable mitigation, but these are not shown on the plans and would not be permitted under Class MA. Without these windows, the recommended measures cannot be implemented, and adequate living conditions cannot be assured. The proposal is therefore contrary to Class MA and paragraph 130 of the NPPF.
