1.The proposed development does not comply with criteria 9A of Class MA, which states that "Schedule 2 does not grant permission for, or authorise any development of, any new dwellinghouse that does not comply with the nationally described space standard issued by the Department for Communities and Local Government on 27th March 2015(1)". Flat 02 has an internal floor to ceiling height of 2.3m for approximately 60.9% of the gross internal area at second floor level, which fails to meet the minimum standard of at least 75% of the gross internal area in line with the DCLG Technical Space Standards. Consequently, under the provisions of Schedule 2, Part 3, Class MA of the Town and Country Planning (General Permitted Development) (England) Order 2021 (as amended), the prior approval of the Local Planning Authority is refused.
