1.The proposal fails to meet the criteria set in paragraph MA.2. (a) under Class MA of Part 3 to Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended with respect to transport impacts of the development. The proposal is considered to make inadequate provision for the collection of waste and refuse from the site, with no acceptable refuse strategy provided. Furthermore, the over-provision of car parking, in combination with the inadequate cycle parking provision, would fail to make adequate provision for sustainable travel and would be contrary to the provisions of Policies T5 and T6.1 of the London Plan. Given the location of the site, a car free scheme would be acceptable, however, there is no legal undertaking for future occupiers of the site to be excluded from applying for over-subscribed residential parking zone surrounding the site. Therefore, in the absence of legal agreement under Section 16 of the Greater London Council (General Powers) Act 1974 to prevent future occupiers of the proposed dwellings from obtaining parking permits, it is considered that there would be no appropriate mitigating measures to ensure there would be no impact on the availability of parking for existing residents with resultant harm to the amenity and convenience of existing residents in the area and the safe and free flow of traffic on nearby streets. In this respect the proposal is unacceptable in terms of transport and highways impacts.
2.The proposal fails to meet the criteria set in paragraph MA.2. (d) under Class MA of Part 3 to Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended with respect potential flood risk impact upon the proposed flats especially the ground floor flats, without the implementation of the mitigation recommendations, some of which would be unacceptable without planning permission. Therefore, in the absence of satisfactory information, it would be likely that the future occupiers of the site would suffer from flood risk, which would unacceptably impact on their safety.
