The amendments sought are considered to materially affect the character and nature of the development previously approved and cannot be regarded as a minor amendment.
The NMA proposal for creation of access road is considered to be a significant change to the pre-commencement condition. As such, the applicant is advised to submit a separate application to the planning authority requesting a variation of the condition under Section 73 of the Town and Country Planning Act.
The submission of a fresh planning application is therefore deemed necessary in this case. |
