1.The amendments and modification to the wording of the conditions listed below are considered to of a minor nature non material as the proposed wording would still secure the delivery of high quality development and would be unlikely to compromise the appropriate measures with respect to security, energy efficiency and the sustainability of the building. And hence, and will not require resubmission of a fresh planning application. The following amendments are deemed to be accepted: Condition 20 - Secure by Design The proposed development shall achieve a Certificate of Compliance in respect of the Secured by Design scheme, or alternatively achieve security standards (based on Secured by Design principles) to the satisfaction of the Metropolitan Police, details of which shall be provided to the Local Planning Authority and approved in writing. The occupation of the building hereby approved shall cease within 6 months of failure to meet any of the following criteria: i) Within 3 months of the date of occupation a Certificate of Compliance in respect of the Secured by Design scheme, or alternatively achieve security standards (based on Secured by Design principles) to the satisfaction of the Metropolitan Police shall be submitted for the written approval of the local planning authority. ii) If within 11 months of the date of this decision, the local planning authority refuse to approve the submitted details or fail to give a decision within the prescribed period, an appeal shall have been made to, and accepted as validly made by, the Secretary of State. iii) If an appeal is made in pursuance of ii) above, that appeal shall have been finally determined and the submitted details shall have been approved by the Secretary of State. All security measures applied to the approved development shall be permanently retained thereafter. Reason: In the interests of providing a safer environment for future residents and visitors to the site and reduce the fear of crime. Condition 27 - Energy Statement Compliance The development shall be carried out in accordance to the approved energy statement to ensure the development will follow the hierarchy of energy efficiency, to secure the reduction in CO2 emissions. Within 3 months of the first occupation, evidence (e.g. photographs, copies of installation contracts and as-built worksheets prepared under SAP or the National Calculation Method) should be submitted to the Local Planning Authority and approved in writing to demonstrate that the development has been carried out in accordance with the approved Energy Strategy, unless otherwise agreed by the Local Planning Authority in writing. The occupation of the building hereby approved shall cease within 6 months of failure to meet any of the following criteria: i) Within 3 months of the date of occupation evidence to demonstrate compliance with the approved Energy Statement shall be submitted for the written approval of the local planning authority. ii) If within 11 months of the date of this decision, the local planning authority refuse to approve the submitted details or fail to give a decision within the prescribed period, an appeal shall have been made to, and accepted as validly made by, the Secretary of State. iii) If an appeal is made in pursuance of ii) above, that appeal shall have been finally determined and the submitted details shall have been approved by the Secretary of State. All energy measures installed at the approved development in accordance with the approved Energy statement shall be permanently retained thereafter. Reason: To ensure that the proposed development is constructed in an environmentally sustainable manner. Condition 31 - Circular Economy Statement Post Completion Report Within 3 months of the first occupation of the development, a Post Completion Report setting out the predicted and actual performance against all numerical targets in the relevant Circular Economy Statement shall be submitted to the GLA at: circulareconomystatements@london.gov.uk, along with any supporting evidence as per the GLA's Circular Economy Statement Guidance. The Post Completion Report shall provide updated versions of Tables 1 and 2 of the Circular Economy Statement, the Recycling and Waste Reporting form and Bill of Materials. Confirmation of submission to the GLA shall be submitted to, and approved in writing. The occupation of the building hereby approved shall cease within 6 months of failure to meet any of the following criteria: i) Within 3 months of the date of occupation evidence to demonstrate a Circular Economy Post Completion Report has been submitted to the GLA will be submitted to the Local Planning Authority. ii) If within 11 months of the date of this decision, the local planning authority refuse to approve the submitted details or fail to give a decision within the prescribed period, an appeal shall have been made to, and accepted as validly made by, the Secretary of State. iii) If an appeal is made in pursuance of ii) above, that appeal shall have been finally determined and the submitted details shall have been approved by the Secretary of State. Reason: In the interests of sustainable waste management and in order to maximise the re-use of materials. you are reminded that this permission would not alter the other conditions in the approved scheme and nor the legal agreement.
