1.The proposal would result in the unacceptable loss of privacy to No. 196 Abbs Cross Lane by reason of overlooking from the first floor of the proposed 2 storey dwelling detrimental to the residential amenity of adjacent occupiers contrary to Local Plan policy 7 and paragraph 130(f) of the NPPF.
2.The proposed 2 storey detached dwelling by reason of its height and associated bulk and massing would form a conspicuous and incongruent feature in the area and would significantly harm its character and appearance contrary to Local Plan policies 10 and 26 and paragraph 130(c) of the NPPF.
3.The proposal would be liable for contributions under CIL Regulations for both MCIL and HCIL based on any net increase in residential floor area. The liability would be considered further at Reserved Matters stage when the scale of development is known.
4.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the Agent on the 13/04/22.
