1.The proposed development would, by reason of its design, layout and orientation, result in development which does not appropriately respond to the building forms and patterns of development in the surrounding area and would thereby have an inappropriate and unacceptable appearance in the street scene which would neither maintain or enhance the special character of the Gidea Park Special Character Area contrary to Policy DC61 and DC69 of the LDF Core Strategy and Development Control Policies DPD.
2.In the absence of a legal agreement to secure contributions towards the demand for school places arising from the development, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, contrary to the provisions of Policies DC29 and DC72 of the Development Control Policies DPD and Policy 8.2 of the London Plan.
3.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to Michael Breden of Spaces Architecture by email on 23 March 2016.
4.The planning obligations recommended in this report have been subject to the statutory tests set out in Regulation 122 of the Community Infrastructure Levy Regulations 2010 and the obligations are considered to have satisfied the following criteria:- (a) Necessary to make the development acceptable in planning terms; (b) Directly related to the development; and (c) Fairly and reasonably related in scale and kind to the development.
