1.The proposed development would, by reason of its additional height, appear as an unacceptably dominant and visually intrusive feature in the streetscene harmful to the character and appearance of the surrounding area contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD and Policy 7.4 of the London Plan
2.The proposed development would, by reason of its additional height, result in an adverse impact upon the flank window of No. 9 Queens Gardens, Upminster, which would be harmful to the residential amenity of the occupants of this neighbouring property contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
3.The proposed layout of the development would be inadequate resulting in substandard accommodation for future residents through insufficient head height. As a result, the development represents an overdevelopment of the site, which would be detrimental to future residential amenity, contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD and Policy 3.5 of the London Plan (as amended).
4.In the absence of a legal agreement to secure contributions towards the demand for school places arising from the development, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, contrary to the provisions of Policies DC29 and DC72 of the Development Control Policies DPD and Policy 8.2 of the London Plan.
5.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: During consideration by the committee, members placed different weight on the planning merits and decided to refuse planning permission.
