| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | The proposed development hereby approved shall be constructed in accordance with the materials detailed on the submitted drawings submitted with the application form unless otherwise agreed in writing by the Local Planning Authority.
Reason: To ensure that the appearance of the proposed development will harmonise with the character of the surrounding area. |
| 4. | The garden area shall not be subdivided at any time and nor shall there be any additional pedestrian or vehicular accesses into the site.

In order that the annex approved remains ancillary to the main dwelling. |
| 5. | Any residential occupation of the building hereby approved shall be limited to immediate family members of the family occupying the main house at 20 Walden Avenue, Rainham for residential purposes and shall not be occupied by any other persons.

| 6. | The granny annex hereby permitted shall not be arranged or disposed of as a separate unit of residential accommodation from the use of the main dwelling.

| 7. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, no window or other opening (other than in accordance with those shown on the submitted and approved plans) shall be formed in any of the walls of the building hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority.
Reason:-
In order to ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future. |
| 8. | No demolition or development shall take place until a written scheme of investigation (WSI) has been submitted to and approved by the local planning authority in writing. For land that is included within the WSI, no demolition or development shall take place other than in accordance with the agreed WSI, which shall include the statement of significance and research objectives, and
A. The programme and methodology of site investigation and recording and the nomination of a competent person(s) or organisation to undertake the agreed works
B. Where appropriate, details of a programme for delivering related positive public benefits
C. The programme for post-investigation assessment and subsequent analysis, publication & dissemination and deposition of resulting material.
Reason: Assets of archaeological interest on this site are likely to be affected by the development. The planning authority wishes to secure archaeological investigation, recording and dissemination of results, in accordance with Section 16 of the NPPF and Havering Local Plan policy 28. |
| 9. | The window to the front facing elevation serving the bathroom shall be obscure-glazed, and non-opening unless the parts of the window which can be opened are more than 1.7m above the floor of the room in which the window is installed.
Reason - In the interest of privacy and to protect the amenity of the adjacent neighbours |
| 10. | For any development where a flood risk is identified, the Council as the Lead Local Flood Authority want to see developers consider and implement flood resilience/resistance measures into the buildings themselves. This is not to stop development but to ensure the protection for future residents is maintained and enhanced.
The following measures are strongly recommended, although this list is not exhaustive:-
- Raising the level of the building by at least 300mm above local levels;
- Waterproof membrane in the ground floor;
- Waterproof plaster and waterproofing to ground floor;
- Electrics from the upstairs down and sockets high up off the ground floor;
- Non return valves on the sewerage pipes;
- Emergency escape plan for each individual property;
- Air brick covers; and
- Movable flood barriers for entrances |
| 11. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with the agent via email on 15th August 2025. The revisions involved re-designing the proposed annex. The amendments were subsequently submitted on 5th September 2025. |
