1.The addition of pitched roofs and rear dormers to units 2 and 3 would materially change the contribution of the development to the street-scene. The extant scheme under reference P1035.20 formed an appropriate response to the constraints of the site and through the low level of units 2 and 3 as approved limited their presence in the street-scene and rear garden environment. The resultant dwellings proposed would through their increased scale, bulk and mass appear as incongruous and unacceptably dominant, overbearing and visually intrusive features in the rear gardens of adjacent premises which would be harmful to the appearance and character of the surrounding area when viewed alongside the other elements proposed including alterations to the host dwelling. There would through the alterations proposed be a sense of overdevelopment and the proposals would also be detrimental to neighbouring residential amenity through increased overlooking, loss of privacy, sense of overbearing as well as contributing to loss of light and overshadowing of adjoining sites. The development is therefore contrary to Policies 7 and 26 of the Havering Local Plan 2016-2031, the Residential Extensions and Alterations SPD, Policies D3 and D4 of the London Plan 2021 and Paragraph 130 of the NPPF which requires fundamentally that development provide a high standard of amenity for future users of development and that development add to the overall quality of the area.
2.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the agent in writing 25-03-2022.
3.The proposal, if granted planning permission on appeal, would be liable for the Mayor of London Community Infrastructure Levy (MCIL2) and also the Havering Community Infrastructure Levy (HCIL). Based upon the information supplied with the application, the CIL payable would be: Mayoral CIL (MCIL2) at a rate of £25 per sqm equivalent to £2,975 Havering CIL (HCIL) at a rate of £125 per sqm equivalent to £14,875 Each contribution would be subject to indexation.
