1.This permission shall be for a limited period only expiring on 25 April 2020, or upon commencement of the use of the development permitted under P0144.19. Reason: To enable the Local Planning Authority to retain control and in order that the development complies with Development Control Policies Development Plan Document Policy DC61, DC26 and DC55.
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
3.Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 the use hereby permitted is for a use of day nursery under a D1 use only and the building shall be used for no other purpose(s) whatsoever including any other use in Class D1 of the Order. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
4.Prior to the commencement of the use as a daycare nursery, acoustic fencing to the boundary of the application site and sound absorbent ground surfacing for the play area shall be installed in accordance with details previously submitted to and approved in writing by the Local Planning Authority. The acoustic fence and sound absorbent surfacing shall be permanently retained for the duration of the use hereby permitted. Reason:- To enable the Local Planning Authority to retain control and to avoid disturbance to adjoining residents, and that the development accords with Development Control Policies Development Plan Document Policy DC61.
5.The premises shall not be used as a Day Nursery hereby permitted other than between the hours of 06:30 and 19:00 on Mondays to Fridays and not at all on Saturdays, Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
6.The number of children accommodated within the premises hereby approved shall not exceed 20, and the number of children within the play area to the rear of the property hereby approved shall not exceed 10 at any one time without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control and to avoid disturbance to adjoining residents, and that the development accords with Development Control Policies Development Plan Document Policy DC61
7.The play area to the rear of the premises shall not be used outside the hours of 09:00 and 17:00 Monday to Friday. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
8.Before the development hereby permitted commences details of a scheme shall be submitted to and approved in writing by the local planning authority which specifies the provisions to be made for the control of noise emanating from the site. Such scheme as may be approved shall be implemented prior to first occupation and thereafter retained in accordance with such details. Reason: To prevent noise nuisance to above/adjoning/adjacent properties.
9.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework 2018.
