1.The premises shall not be used for the purposes hereby permitted other than between the hours of 08:00 to 23:00 Sunday-Thursday and 08:00 to 00:00 Friday-Saturday without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity.
2.This equipment with respect to ventilation and extract system that has been approved shall be continue to be properly maintained and operated within design specifications during normal working hours. Reason:- To safeguard the amenities of the adjoining occupiers.
3.The refuse and recycling facilities approved in writing by the Local Planning Authority shall continue to be permanently retained thereafter. Reason:- To protect the amenity of occupiers of the development.
4.The cycle storage approved in writing by the Local Planning Authority shall continue to be permanently retained. Reason:- In the interests of providing a wide range of facilities for non-motor car residents and sustainability.
5.The equipment with respect to the agreed scheme outlining full details of the acoustic / noise insulation performance as have already been approved and implemented in accordance with specification enshrined in the noise report reference: RFE-0287-1 9-02 shall continue to be maintained. Reason: To avoid, mitigate and minimize adverse impacts on health and quality of life from noise.
6.The approved scheme which specifies the provisions made for the control of noise emanating from the application site shall continued to be maintained in accordance with such details. Reason: To prevent noise nuisance to adjoining/adjacent properties.
7.As per scheme already approved noise levels expressed as the equivalent continuous sound level LAeq (1 hour) when calculated at the boundary with the nearest noise sensitive premises shall not exceed LA90 -1 OdB and shall continue to be maintained thereafter to the satisfaction of the Local Planning Authority. Reason: To prevent noise nuisance to adjoining/adjacent properties.
8.The agreed scheme with respect to control of the transmission of noise and vibration from any mechanical ventilation shall continue to be properly maintained and operated during normal working hours. Reason: To protect the amenity of occupiers of nearby premises
9.The approved scheme with respect to parking arrangement shall continue to be maintained. Reason: In order to ensure the adequate functioning of the parking provision within the site in the interests of amenity and highway safety.
10.Apart from the storage (refuse, recycling and cycling facilities) hereby approved, no goods or materials shall be stored within the space to the rear which shall only be retained for clear access, turning areas and for car parking purposes. Reason:- In the interests of highway safety.
11.There shall be no deliveries to the commercial uses on the ground floor other than between the hours of 8am to 11pm Monday to Friday, 8am to 5pm on Saturdays and no deliveries on Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason To enable the Local Planning Authority to retain control in the interests of amenity and in order to ensure the adequate functioning of the parking provision within the site in the interests of amenity and highway safety.
12.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
