1.The proposed development, by virtue of its siting and site layout gives rise to an incongruous form of development, which fails to reflect or complement the established pattern of development in the area, resulting in harm to the character and appearance of the surrounding residential environment, contrary to London Plan Policy D3 and Havering Local Plan Policies 7, 10 and 26.
2.The proposed development would provide private amenity spaces that are subject to significant overlooking from surrounding first floor windows, in particular from nos. 2-4 Hamilton Drive and 133 Southend Arterial Road, resulting in poor levels of privacy and unacceptable living conditions for future occupiers, contrary to London Plan Policy D6 and Havering Local Plan Policy 7.
3.The proposed development fails to provide onsite car parking in a low public transport accessibility location and is not supported by adequate evidence demonstrating that additional parking demand arising from the development could be safely accommodated on surrounding streets, resulting in harm to highway safety, contrary to Havering Local Plan Policy 24.
4.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, it was necessary to issue a decision as close to the statutory timeframe as possible as opposed to seeking amendments which would have significantly delayed the application, given that there was no post appeal consultation.
5.The proposal, if granted planning permission on appeal, would be liable for the Mayor of London and Havering Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the Mayoral CIL payable would be £2600 based on £25.00 per square metre and the Havering Community Infrastructure Levy (HCIL) would be a charge of £13,000 based on calculation of £125 per square metre.
