No.Condition Text
.The proposed development, by reason of the provision of the readily visible areas of private amenity space (one to the front of the proposed building), does not provide private amenity space of adequate quality and usability, suitable for day to day uses and not overlooked from the public realm. In addition, the amenity space currently available to the existing residents of Ash Tree Court will be obliterated by the erection of the proposed two storey building. Overall, this scheme is considered to be an over-development of the site in question. The works will detrimentally impact upon both existing and future occupiers, along with the character of the surrounding area contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
.The development would, by reason of the dwelling siting, height and proximity to the boundaries of the plot, give rise to a cramped appearance and overdevelopment of the site, which would be harmful to the garden scene and character of the surrounding area contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD and the Residential Extensions and Alterations SPD.
.The proposed development would, by reason of its position and proximity to neighbouring properties cause overlooking and loss of privacy which would have a serious and adverse effect on the living conditions of adjacent occupiers, contrary to Policy DC61 of the LDF Core Strategy and Development Control Policies DPD.
.In the absence of a legal agreement to secure contributions towards the demand for school places arising from the development, the proposal fails to satisfactorily mitigate the infrastructure impact of the development, contrary to the provisions of Policies DC29 and DC72 of the Development Control Policies DPD and Policy 8.2 of the London Plan.
.The proposal, if granted planning permission on appeal, would be liable for the Mayor of London Community Infrastructure Levy (CIL). Based upon the information supplied with the application, the CIL payable would be £2880. Further details with regard to CIL are available from the Council's website.
.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to Mr Gary Cumberland (Agent) by email dated 30/4/18.
