1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason: To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason: For the avoidance of doubt and to ensure that the development is carried out as approved.
3.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, the premises (No.152 & No.154) shall only be used for the purposes specified in the application (Creche, day nursery or day centre) (Use Class E(f)) and for no other purpose (including any other purpose in Class (E) of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) (or any provision equivalent to that Class in any Statutory Instrument revoking and/or re-enacting that Order). Reason: To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application.
4.No demolition or construction works, or deliveries, into the site shall take place other than between the hours of 08.00 to 18.00 on Monday to Friday and 08.00 to 13.00 hours on Saturdays unless agreed in writing with the local planning authority. No demolition or construction works, or deliveries shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the local planning authority. Reason: To protect residential amenity.
5.The use of the premises shall only take place between the hours of 07:30 - 18:30 hours, Mondays to Fridays and not at any time on Saturdays, Sundays. Bank or Public Holidays. Reason: To protect residential amenity
6.The outdoor playing area to the rear of the building shall be used only between the hours of 09:00 - 18:00 hours, Mondays to Fridays and not at any time on Saturdays, Sundays, Bank or Public Holidays. Reason: To protect residential amenity
7.The maximum number of children at the premises (152-156) at any one time shall not exceed 56 children and a maximum of 40 children plus adult supervisors shall use the rear garden as an outdoor play space as demarcated on the approved layout plan. Reason: To protect residential amenity
8.Prior to the increase in the number of children in the nursery the landscaping buffer and acoustic fencing shall be implemented as shown on Drg 46236/PD/4 and maintained for life time of the development permitted. Within three months of the installation of the measures required by this condition, a post installation noise test shall be carried out and a noise report shall be presented to the Local Planning Authority in writing for approval - should the noise report suggest further mitigation measures, these should be implemented in accordance with the recommendations. Reason: To protect residential amenity
9.Details of any external lighting of the site shall be submitted to, and approved in writing by, the Local Planning Authority prior to the commencement of the development. This information shall include a layout plan with beam orientation and a schedule of equipment in the design (luminaire type, mounting height, aiming angles and luminaire profiles). The lighting shall be installed, maintained and operated in accordance with the approved details unless the Local Planning Authority gives its written consent to the variation. Reason: To protect the appearance of the area, the environment and local residents from light pollution.
10.The expanded/extended use hereby approved shall operate at all times in accordance with the Travel Plan measures set out in Appendix 1 of the submitted Planning Statement. Reason: In order to reduce reliance on vehicle journeys.
