1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
3.The proposed development hereby approved shall be constructed in accordance with the materials detailed under the materials section of the application form unless otherwise agreed in writing by the Local Planning Authority. Reason: To ensure that the appearance of the proposed development will harmonise with the character of the surrounding area.
4.Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015, no window or other opening (other than those shown on the submitted and approved plans) shall be formed in the flank walls of the buildings hereby permitted, unless specific permission under the provisions of the Town and Country Planning Act 1990 has first been sought and obtained in writing from the Local Planning Authority. Reason:- In order to ensure a satisfactory development that will not result in any loss of privacy or damage to the environment of neighbouring properties which exist or may be proposed in the future.
5.The works hereby permitted shall be carried out entirely in accordance with the Arboricultural Report and Method Statement for Tree Protection Measures authored by Andrew Day Arboricultural Consultancy Ltd dated 17 July 2024. Reason: In order to maintain the existing vegetation at the site, which makes an important contribution to the character of the area, and to accord with Policy 27 of the Council's Local Plan.
6.During construction of the development hereby permitted, no trees located within or adjacent to the application site 60 Rush Green Road Romford RM7 0QB shall not be lopped or felled without the written consent of the local planning authority. Reason: In order to maintain the existing vegetation at the site, which makes an important contribution to the character of the area, and to accord with Policy 27 of the Council's Local Plan.
7.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
8.The Council's Tree Team is responsible for the maintenance of trees on Havering's highways and on land it owns and manages. The applicant is advised that they must not sever any substantial tree roots close to the base of the tree as this would make the tree unstable and likely to fall. If this happens due to action taken to undertake the development hereby permitted, the Council would consider the applicant liable for any damage caused and for any damage to the street trees. Prior to commencement of any work the Arboriculture officer for the Council's Tree Team should be informed and asked to carry out an inspection.
