1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
3.The premises shall not be used for the purposes hereby permitted other than between the hours of 12:00 and 22:00 Monday to Saturday and 12:00 to 21:00 on Sundays and not at all on Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity.
4.At all times during operation of the use, a removable means of enclosure shall be used to demarcate the seating area Reason:- In the interest of highway safety and to ensure that the development.
5.The external tables and seating hereby approved shall be removed from the pavement between the hours of 20.00 and 07:00 hours (the following morning) daily. Reason:- In the interests of pedestrian safety and amenity, and to ensure that the Local Plan Policies 23 and 26.
6.The outdoor seating area hereby permitted shall consist of no more than eight tables and 24 chairs and will only be situated inside an area of 5.22m in depth from the front of the building facade and must not extend to the adjacent pedestrian walkway. Reason:- In the interests of pedestrian safety and amenity, and to ensure that the Local Plan Policies 23 and 26.
7.No amplified music or speech shall be played or reproduced in the outside pavement seating area. Reason:- To prevent noise nuisance to adjoining properties, protect amenity, and in order that the development accords with the Local Plan Policies 26 and 34.
8.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraphs 186-187 of the National Planning Policy Framework 2012.
9.The Highway Authority requires the Planning Authority to advise the applicant that planning approval does not constitute approval for changes to the public highway. Highway Authority approval will only be given after suitable details have been submitted, considered and agreed. The Highway Authority requests that these comments are passed to the applicant. Any proposals which involve building over the public highway as managed by the London Borough of Havering, will require a licence and the applicant must contact StreetCare, Traffic & Engineering on 01708 433750 to commence the Submission/ Licence Approval process.
10.The Applicant is advised that this decision grants planning consent only. Separate consent will need to be obtained under the Highways Act and Licensing. 11.The applicant is advertised that this permission does not give consent for any external advertising , including that on the mobile planters/barriers around the seating area, for which separate consent should be sought under the Town and Country Planning Control of Advertisement Regulations.
