1.Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (as amended) the use hereby permitted shall be limited to a tuition centre only and shall be used for no other purpose(s) whatsoever including any other use in Class F of the Order, unless otherwise agreed in writing by the Local Planning Authority. Reason:- To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application.
2.The maximum number of children/students on the premises at any one time shall not exceed 10. Reason; To prevent noise nuisance to adjoining properties and to protect amenity.
3.Within 3 months of the permission hereby approved, a management plan for the operation of the development shall be submitted to the Local Planning Authority for approval. The management plan shall include: - measures to restrict activities (gathering/waiting/children playing) in outdoor areas around the premises which could give rise to disturbance to neighbouring occupiers; - measures to ensure that all parking associated with the premises takes place responsibly; - complaints process including measures to notify and inform occupiers of nearby residential properties on how to raise issues and procedure for handling complaints. The approved management plan shall be implemented in full and within 1 months of the date of approval by the Local Planning Authority. The approved measures/works in management plan shall be permanently implemented/retained. Reason: To prevent noise nuisance to adjoining properties and protect amenity.
4.Within 3 months of the permission hereby approved, a Travel Plan shall be submitted to the Local Planning Authority for approval. The Travel Plan should include measures to: - encourage use of sustainable transport so that parents/students/tutors/staff prioritise sustainable transport/travel to/from the premises; - minimise the impact of any parking associated with the use of the premises; - provision of travel information within the building and in all advertising/websites and communications related to the use; - monitoring and review mechanisms to assess the effectiveness of the measures in the travel plan. The travel plan shall thereafter be implemented immediately upon approval by the Local Planning Authority. On the first, third and fifth anniversary of this permission, evidence shall be submitted to demonstrate compliance with the monitoring and review mechanisms agreed within the approved Travel Plan. Reason: In the interest of highways safety, free flow of traffic and to prioritise sustainable modes of travel.
5.The use hereby permitted shall only be carried out on the site between the hours of 8:30am and 9pm Mondays to Saturdays, and 9am and 7pm on Sundays, Bank or Public Holidays. Reason:- To minimise the impact of the development on the surrounding area in the interests of amenity.
6.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with paragraph 38 of the National Planning Policy Framework, improvements required to make the proposal acceptable were negotiated with the applicant who provided additional information with respect to numbers of visitors to the application site and
