| 1. | The proposed retention of the utility outbuildings, by reason of their number, siting and utilitarian design, would result in the introduction of additional built form beyond that approved under ref. APP/B5480/W/21/3268154 / P1590.20. Whilst modest individually, the cumulative presence of these structures would create visual clutter and erode the spatial quality, openness and layout of the development as approved on appeal. The proposal would therefore represent a materially different and more intensive form of development than that previously assessed and would cause harm to the character and appearance of the site, contrary to Policy 26 of the Havering Local Plan and the design principles of the National Planning Policy Framework. |
| 2. | The siting of the utility outbuildings in close proximity to habitable room windows would result in visually intrusive structures within the immediate outlook of occupiers. Notwithstanding the limited height of the structures, their proximity, combined with associated enclosures and equipment, would give rise to an unduly dominant presence and an increased sense of enclosure, materially diminishing the quality of outlook from affected room. The proposal would therefore result in unacceptable harm to residential amenity, contrary to Policy 7 of the Havering Local Plan and the National Planning Policy Framework. |
| 3. | The proposal seeks to retrospectively regularise built development that was not included within, and materially departs from, the scheme approved on appeal under ref. APP/B5480/W/21/3268154 / P1590.20. The development at the site has not been carried out in accordance with the approved plans and is subject to ongoing enforcement proceedings. The approval of this variation would, in effect, contribute to the incremental regularisation of unauthorised development and undermine the integrity of the appeal decision. In the absence of sufficient justification, the proposal is considered unacceptable and contrary to the objectives of the National Planning Policy Framework, which seeks to secure high quality development and maintain public confidence in the planning system. |
| 4. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, it was necessary to issue a decision as close to the statutory timeframe as possible as opposed to seeking amendments which would have significantly delayed the application. |
