1.The development to which this permission relates must be commenced not later than three years from the date of this permission. Reason:- To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004).
2.All new external finishes shall be carried out in materials to match those of the existing building(s) to the satisfaction of the Local Planning Authority. Reason:- To safeguard the appearance of the premises and the character of the immediate area, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61.
3.Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 the extension hereby permitted shall be used solely in connection to the existing children's day nursery and pre/afterschool club use at 140 Squirrels Heath Road only and shall be used for no other purpose whatsoever including any other use in Class D1 of the Order, unless otherwise agreed in writing by the Local Planning Authority. Reason:- To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application, and that the development accords with the LDF Core Strategy and Development Control Policies Development Plan Document, Policy DC61.
4.The premises shall not be used for the purposes herby permitted other than between the hours of 07:00 and 19:00pm on Mondays to Fridays and not at all on Saturdays, Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To minimise the impact of the development on the surrounding area in the interests of amenity, and that the development accords with the LDF Core Strategy and Development Control Policies Development Plan Document, Policy DC61.
5.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans, particulars and specifications. Reason:- The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61.
6.No construction works or deliveries into the site shall take place other than between the hours of 08.00 to 18.00 on Monday to Friday and 08.00 to 13.00 hours on Saturdays unless agreed in writing with the Local Planning Authority. No construction works or deliveries shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the Local Planning Authority. Reason:- To protect residential amenity, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61.
7.The combined number of children accommodated at No. 142 and No. 140 Squirrels heath Road at any one time shall not exceed 40 including the applicants own children. Reason: To enable the Local Planning Authority to retain control and to avoid disturbance to the occupiers of neighbouring properties.
8.The number of children using the rear garden of 140 Squirrels Heath Road at any one time shall not exceed 12, including the applicants own children. At no time shall the rear garden of 142 Squirrels Heath Road be used for this purpose. Reason:- To enable the Local Planning Authority to retain control and to avoid disturbance to the occupiers of neighbouring properties.
9.The rear garden to number 140 Squirrels Heath Road shall not be used for recreation purposes other than between the hours of 10:00 and 16:00pm on Mondays to Fridays and not at all on Saturdays, Sundays, Bank or Public holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control and to avoid disturbance to the occupiers of neighbouring properties.
10.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraphs 186-187 of the National Planning Policy Framework 2012.
