| 1. | The development (conservatory) to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The use hereby permitted shall be for supported living for adults with learning difficulties (sui generis use)only and shall be used for no other purpose(s) whatsoever and shall be limited to a maximum of 17 residents.
Reason:-
To restrict the use of the premises to one compatible with the surrounding area and to enable the Local Planning Authority to exercise control over any future use not forming part of this application, and that the development accords with the Development Control Policies Development Plan Document Policy DC61 |
| 3. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans, including details of materials for the approved extension (as set out on page one of this decision notice).
Reason:-
The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 4. | Unless within two months of the date of this decision provision has been made within the site for eight car parking spaces and one wheelchair accessible space in accordance with the details shown on drawing no. 16-031/04 approved as part of this application the use of the site for supported living shall cease until such time as the scheme has been implemented.
The car parking spaces once provided shall be made permanently available for use for the lifetime of the development approved.
Reason:-
Car parking provision for the use approved is necessary to ensure that there is adequate off-street car parking provision in the interests of highway safety in accordance with Development Control Policies Development Plan Document Policies DC33 and DC61. Without such provision it would be unacceptable for the use to continue. |
| 5. | Unless within one month of the date of this decision secure cycle storage for staff is provided in accordance with the details shown on drawing no. 16-031/04 approved as part of this application the use of the site for supported living shall cease until such time as the provision has been made.
The secure cycle storage once provided shall be retained for the lifetime of the development approved.
Reason:-
Secure cycle storage for staff is necessary in the interests of providing a wide range of facilities for non-motor car residents and sustainability. Without such provision it would be unacceptable for the use to continue. |
| 6. | Unless within one month of the date of this permission a 2.1 by 2.1 metre pedestrian visibility splay on either side of the proposed access, set back to the boundary of the public footway and with no obstruction or object higher than 0.6 metres within the visibility splay, has been provided in accordance with in the details shown on drawing no. 16-031/04 approved as part of this application, the use of the site for supported living shall cease until such time as the provision has been made.
The visibility splay shall be maintained for the lifetime of the development approved.
Reason:-
A pedestrian visibility splay as specified in necessary to ensure pedestrian safety, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC32. Without such provision it would be unacceptable for the use to continue. |
| 7. | Unless within one month of the date of this permission provision has been made for refuse and recycling facilities in accordance with details shown on drawing no. 16-031/04 approved as part of this application, the use of the site for supported living shall cease until such time as the provision has been made.
The facilities shall be retained for the lifetime of the development approved.
Reason:-
Refuse and recycling facilities are considered necessary to protect the amenity of occupiers of the development and also the locality generally and ensure that the development accords with the Development Control Policies Development Plan Document Policy DC61. Without such provision it would be unacceptable for the use to continue. |
| 8. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: In accordance with para 186-187 of the National Planning Policy Framework 2012, improvements required to make the proposal acceptable were negotiated with Ian Stephenson, over the telephone and by e-mail on the 11th and 12th May 2016. The revisions involved a change in the description of development and a revised plan showing car parking, visibility splays and cycle storage. The amendments were subsequently submitted on 12th May 2016. |
