1. | The proposed hot food takeaway use would be within 400 metres walking distance from the entrance and exit of an existing secondary school and the individual unit would not be separated by a minimum of 3 units in alternative use contrary to Havering Local Plan Policy 13, and London Plan (2021) policy E9. |
2. | In the absence of information to demonstrate otherwise, the proposed takeaway use, by reason of noise and disturbance caused by customers entering and leaving the premises, vehicles parking and manoeuvring, particularly during the evening hours of operation, would be detrimental to the amenities of the occupiers of nearby residential properties, contrary to Havering Local Plan Policies 7 and 34, and London Plan (2021) policies D14 and T7. |
3. | In the absence of compelling evidence to the contrary, the proposed fume extraction system, by virtue of its proximity to residential flats, would have an unacceptable impact on the residential amenity due to increased levels of noise and vibration and odours associated the operation of the extraction equipment contrary to policies 7, 13, and 34 of the Having Local Plan and London Plan (2021) policy D14. |
4. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the Agent by email on the 27-06-22. |
