1.Within 3 months of the date of this decision, the existing flue system needs to be removed together with materials resulting from its removal and the new flue system shall be installed in accordance with the approved drawings RM7-PR706, RM7-PR707 and RM7-PR708 and shall be retained and maintained thereafter. Reason: To ensure that the appearance of the proposed development will not unacceptably impact on the character of the surrounding area or to prevent loss of amenity to neighbouring (residential) properties from noise.
2.The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice). Reason:- For the avoidance of doubt and to ensure that the development is carried out as approved.
3.The Noise Mitigation Methods recommended in the Noise Impact Assessment report produced by Sound Licensing Acoustics, dated 20 March 2023, paragraph 8.5 (Noise) submitted in support of this application shall be implemented within 3 months from the time of approval. The plant shall be serviced regularly in accordance with manufacturers instructions and as necessary to ensure that the requirements of the condition are maintained. If at any time the plant is determined by the Local Planning Authority to be failing to comply with this condition, it shall be switched off and not used again until it is able to comply. Reason: To prevent loss of amenity to neighbouring (residential) properties from noise.
4.The Vibration Mitigation Methods recommended in the Noise Impact Assessment report produced by Sound Licensing Acoustics, dated 20 March 2023, paragraph 8.6 (Vibration) submitted in support of this application shall be implemented within 3 months from the time of approval. If at any time the plant is determined by the Local Planning Authority to be failing to comply with this condition, it shall be switched off and not used again until it is able to comply. Reason: To prevent loss of amenity to neighbouring (residential) properties from vibration.
5.The Odour Mitigation Methods recommended in the Noise Impact Assessment report produced by Sound Licensing Acoustics, dated 20 March 2023, paragraph submitted in support of this application shall be implemented within 3 months from the time of approval. If at any time the plant is determined by the Local Planning Authority to be failing to comply with this condition, it shall be switched off and not used again until it is able to comply. Reason: To prevent loss of amenity to neighbouring (residential) properties from odour.
6.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
