| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason:-
To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason:-
For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | All materials and external finishes shall be carried out strictly in accordance with details shown on approved plans and supporting information provided unless otherwise agreed in writing with the Local Planning Authority.
Reason:-
To ensure that the development is of sufficiently high quality and integrates with the surrounding environment. |
| 4. | No plant or machinery shall be installed unless it meets, or mitigation is employed, to meet the following standard:
The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T) in accordance with BS4142:2014 + A1:2019.
Reason: To protect the amenity of noise sensitive premises from mechanical plant noise. |
| 5. | Prior to the first use of the mechanical ventilation system, chillers, condensers, or any associated plant, the equipment shall be installed with appropriate anti-vibration isolation measures in accordance with the manufacturer's specifications and details.
The installed plant and associated isolation measures shall thereafter be retained and maintained in accordance with those specifications for the lifetime of the development.
Reason: In the interests of safeguarding the amenity of neighbouring occupiers and to prevent noise and vibration disturbance, in accordance with the objectives of the Havering Local Plan 2016-2031. |
| 6. | The 'Fruit Pod' and building to be occupied by 'Marks & Spencer', shall be used only for retail purposes E(a) only and notwithstanding the Town and Country Planning (Use Classes) Order 1987 (as amended) no other subsection of the "E" grouping without specific consent having been sought from the Local Planning Authority.
Reason:-
In the interests of amenity and in accordance with Policies 7, 26 and 34 of the Havering Local Plan 2016-2031. |
| 7. | The Marks & Spencer retail unit shall operate only between the hours of 7AM through 8PM Mon-Fri, and 9AM through 6PM Saturday and Sunday, Bank and Public Holidays and at no other time unless otherwise agreed in writing with the Local Planning Authority.
Reason: In the interest of amenity and to ensure the use is compatible with the surrounding environment. |
| 8. | No demolition or construction works, or deliveries associated with the works hereby permitted shall take place other than between the hours of 08.00 to 18.00 on Monday to Friday and 08.00 to 13.00 hours on Saturdays unless agreed in writing with the local planning authority. No demolition or construction works, or deliveries shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the local planning authority.
Reason: To protect residential amenity. |
| 9. | The independent food pods hereby permitted if used for the sale of hot food shall be limited solely to the equipment shown on drawing no. RP-00-DR-A-00-101 unless otherwise agreed in writing with the Local Planning Authority.
Reason: In the interests of ensuring that the use/activities is compatible with the surrounding environment. |
| 10. | Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework. |
| 11. | The applicant is advised that separate advertisement consent would be required and that the decision issued does not extend to any signage. |
