| 1. | The development to which this permission relates must be commenced not later than three years from the date of this permission.
Reason: To comply with the requirements of Section 91 of the Town and Country Planning Act 1990 (as amended by Section 51 of the Planning and Compulsory Purchase Act 2004). |
| 2. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans (as set out on page one of this decision notice).
Reason: For the avoidance of doubt and to ensure that the development is carried out as approved. |
| 3. | Notwithstanding the details shown on the approved drawings, the construction of the buildings hereby approved shall not commence until there has been submitted to and approved in writing by the Local Planning Authority detailed bay studies in section and elevation showing typical details at minimum metric scale 1:20 to include eaves, external reveals of the windows and doors on each of the elevations, inset brick spandrel panels, porch and balcony details. This should indicate all external materials and dimensions. The development shall be completed in accordance with the approved details and samples and shall thereafter be retained.
Reason: To ensure a high quality finish to the external elevations of the building, in accordance with policies 26 and 27 of the Havering Local Plan and policies D3 and D4 of The London Plan 2021. |
| 4. | Prior to the occupation a detailed scheme of hard and soft landscaping and boundary treatments to serve the development shall be carried out in accordance with approved drawing 2328-GUA-DR-L-002-P06 Keswick Ave Car Park Landscape Outline Specification Notes
The approved hard and soft landscaping scheme shall be carried out before the end of the first planting and seeding season following the first occupation of any part of the buildings agreed in writing by the Local Planning Authority.
Reason: To ensure a satisfactory appearance to the development and protect the amenities of the area and future and neighbouring occupiers in accordance with policies 7 and 26 of the Havering Local Plan |
| 5. | i) Prior to the commencement of any works pursuant to this permission the developer shall submit for the written approval of the Local Planning Authority;
a) A Phase I (Desktop Study) Report documenting the history of the site, its surrounding area and the likelihood of contaminants, their type and extent incorporating a Site Conceptual Model.
b) A Phase II (Site Investigation) Report if the Phase I Report confirms the possibility of a significant risk to any sensitive receptors. This is an intrusive site investigation including factors such as chemical testing, quantitative risk assessment and a description of the sites ground conditions. An updated Site Conceptual Model should be included showing all the potential pollutant linkages and an assessment of risk to identified receptors.
c) A Phase III (Remediation Strategy) Report if the Phase II Report confirms the presence of a significant pollutant linkage requiring remediation. A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to all receptors must be prepared, and is subject to the approval in writing of the Local Planning Authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works, site management procedures and procedure for dealing with any previously unidentified contamination. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation.
d) Following completion of measures identified in the approved remediation scheme mentioned in 1(c) above, a "Verification Report" that demonstrates the effectiveness of the remediation carried out, any requirement for longer-term monitoring of contaminant linkages, maintenance and arrangements for contingency action, must be produced, and is subject to the approval in writing of the Local Planning Authority.
Reason: To protect those engaged in construction and occupation of the development from potential contamination and in order that the development accords with Development Control Policies Development Plan Document Policy DC53.
ii) (a) If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the local planning authority) shall be carried out until a remediation strategy, detailing how this unsuspected contamination shall be dealt with, has been submitted to and approved in writing by the local planning authority. The remediation strategy shall be implemented as approved.
(b) Following completion of the remediation works as mentioned in (a) above, a 'Verification Report' must be submitted demonstrating that the works have been carried out satisfactorily and remediation targets have been achieved.
Reason: To ensure that any previously unidentified contamination found at the site is investigated and satisfactorily addressed in order to protect those engaged in construction and occupation of the development from potential contamination. |
| 6. | No demolition or construction works, or deliveries, into the site shall take place other than between the hours of 08.00 to 18.00 on Monday to Friday and 08.00 to 13.00 hours on Saturdays unless agreed in writing with the local planning authority. No demolition or construction works, or deliveries shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the local planning authority.
Reason: To protect residential amenity. |
| 7. | No works shall take place in relation to any of the development hereby approved shall be carried out until a Construction Method Statement, to control the adverse impact of the development on the amenity of the public and nearby occupiers, is submitted to and approved in writing by the Local Planning Authority.
The Construction Method statement shall include details of:
a. The site access point(s) of all vehicles to the site during the construction phase
b. parking of vehicles of site personnel and visitors;
c. storage of plant and materials;
d. Wheel washing facilities.
e. Measures to monitor and control the emission of dust and dirt during construction.
f. measures for minimising the impact of noise and, if appropriate, vibration arising from construction activities;
g. predicted noise and, if appropriate, vibration levels for construction using methodologies and at points agreed with the Local Planning Authority;
h. a scheme for monitoring noise and, if appropriate, vibration levels using methodologies and at points agreed with the Local Planning Authority;
i. siting and design of temporary buildings if required;
j. scheme for security fencing/hoardings, depicting a readily visible 24-hour contact number for queries or emergencies;
k. details of disposal of waste arising from the construction programme, including final disposal points.
The burning of waste on the site at any time is specifically prohibited.
Reason: Insufficient information has been supplied with the application in relation to the proposed construction methodology. Submission of details prior to commencement will ensure that the method of construction protects residential amenity. It will also ensure that the development accords with Local Plan policy 23, 24 and 34 and London Plan (2021) Policy T7. |
| 8. | If Air Source Heat Pumps are to be installed, before any air source heat pump is commissioned, a report under the provisions of the Microgeneration Installation Standard: MCS 020 shall be submitted to and approved in writing by the Local Planning Authority to determine if the equipment would be deemed permitted development, or a full planning application will be required.
Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant. |
| 9. | No plant or machinery shall be installed unless it meets, or mitigation is employed, to meet the following standard:
The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound.
The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with.
Reason: To protect the amenity of noise sensitive premises from noise from mechanical plant. |
| 10. | The development shall not exceed the water target use of 105 litres or less per person per day in accordance with the submitted Energy and Sustainability Statement 900_03_Keswick Avenue_ _Mar2024 and London Plan standards.
Reason: In order to comply with Policy S15 of the London Plan 2021 |
| 11. | The approved Sustainable Drainage Strategy infiltration system and SUDs Management Strategy as set out in report 2303350-R01 - Flood Risk Assessment and Drainage Strategy FINAL and drawing 2303350-D-001-Drainage Strategy Keswick Avenue Car Park shall be implemented in accordance with the agreed details and maintained in perpetuity.
Reason: In compliance with policy SI13 of the London Plan 2021 |
| 12. | Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking, re-enacting or modifying that Order), no extensions or enlargements shall be constructed and no telecommunications equipment or dishes shall be erected on the external surfaces of the development hereby permitted without the prior written approval of the local planning authority.
Reason: To safeguard the character and visual amenities of the site and wider area and to ensure that the building is constructed in accordance with policy |
| 13. | The development shall be carried out in accordance with the approved Fire Statement F1068-001-01 Keswick Avenue Planning Fire Safety Strategy - Full, prior to occupation and retained as such thereafter.
Reason: In order to provide a safe and secure development. |
| 14. | a) Prior to the above ground works of the development, a Secure by Design Strategy shall be submitted to the Local Planning Authority and the Metropolitan Police NE Designing Out Crime Officers, setting out how Secured by Design principles will be incorporated into the development scheme and how Accreditation will be achieved.
b) Once approved in writing by the Local Planning Authority in consultation with the Metropolitan Police Designing Out Crime Officers, the development shall be carried out in accordance with the agreed details in order to achieve Secured by Design Certification, prior to occupation.
Reason:
In the interest of creating safer, sustainable communities. |
| 15. | The development shall be carried out in accordance with the submitted Tree Protection plan ref. 03961P_TPP_01 Rev A dated 05/02/2024.
Reason:
In order to ensure that the proposals do not adversely affect biodiversity and would satisfy adopted Havering Local Plan 2021 policy 30. |
| 16. | The dwellings hereby approved shall be constructed to comply with Part M4(2) of the Building Regulations - Accessible and Adaptable Dwellings.
Reason:
In order to ensure that the proposals do not adversely affect residential amenity and would satisfy adopted London Plan 2021 policy D5. |
| 17. | No demolition or development shall take place until a stage 1 written scheme of investigation (WSI) has been submitted to and approved by the local planning authority in writing. For land that is included within the WSI, no demolition or development shall take place other than in accordance with the agreed WSI, and the programme and methodology of site evaluation and the nomination of a competent person(s) or organisation to undertake the agreed works.
If heritage assets of archaeological interest are identified by stage 1 then for those parts of the site which have archaeological interest a stage 2WSI shall be submitted to and approved by the local planning authority in writing. For land that is included within the stage 2 WSI, no demolition/development shall take place other than in accordance with the agreed stage 2WSI which shall Include:
A. The statement of significance and research objectives, the programme and methodology of site investigation and recording and the nomination of a competent person(s) or organisation to undertake the agreed works
B. Where appropriate, details of a programme for delivering related positive public benefits
C. The programme for post-investigation assessment and subsequent analysis, publication & dissemination and deposition of resulting material.
This part of the condition shall not be discharged until these elements have been fulfilled in accordance with the programme set out in the stage 2 WS. The development shall be implemented in accordance with the approved details and retained as such thereafter.
Reason:- Heritage assets of archaeological interest may survive on the site. The planning authority wishes to secure the provision of archaeological investigation and the subsequent recording of the remains prior to development, in accordance with Havering Local Plan policy 28 |
