1.The premises shall not be used for the purposes hereby permitted other than between the hours of 06:00 to 17:00 Monday-Saturday, and 08:00 to 16:00 Sunday and Bank Holidays without the prior consent in writing of the Local Planning Authority. Reason:- To enable the Local Planning Authority to retain control in the interests of amenity.
2.This permission is for the use of the premises as a cafe only and not for a hot food take-away. Reason- In order to control the use of the premises in the interests of the nearby residents who may otherwise be disturbed by excessive noise and activity.
3.External doors and windows of the premises shall remain closed (save for the entrance and exit of staff and patrons) before 08.00 hours daily. Reason: In order to protect amenity of the area.
4.The ceiling/party floor insulation between the commercial and residential premises should be checked to ensure it complies with the current Approved Document E of the Building Regulations 1984 and to ensure that the occupiers are provided with reasonable resting/sleeping conditions with reference to British Standard BS8233: 2014 - Sound insulation and noise reduction for buildings - Code of practice. The scheme shall be designed to be 5dB better than that given in Approved Document E 2010. If it is found that the partition does not comply with the regulations, it should be upgraded to comply with the regulations, as a minimum. The details of any works should be approved in writing by the Local Planning Authority before the premises are occupied. The sound insulation and noise control measures shall be carried out strictly in accordance with the details so approved and shall be maintained as such thereafter.Ã?¢?¯ The insulation and measures shall be implemented prior to the first occupation of the development hereby approved. Reason: In order to protect the amenity of residents above the commercial units.
5.A scheme for protecting the occupants of neighbouring residential properties from odours from the hereby permitted use shall be approved in writing by the Local Planning Authority before the hereby permitted extension to the hours of operation commences, and implemented (with the associated verification report) within 3 months of this permission being granted. Reason: In order to protect the amenity of residents above the commercial units.
6.No deliveries or collections shall be taken at or despatched from the site outside the hours of 08.00-18:00 Monday-Friday and 08.00 to 13.00 hours on Saturdays unless agreed in writing with the Local Planning Authority. No deliveries shall take place on Sundays, Bank or Public Holidays unless otherwise agreed in writing by the Local Planning Authority. Reason: In order to protect amenity of the area.
7.No outside seating area shall be permitted outside the hours of 08.00-18:00 Monday-Saturday, and 08.00 to 16.00 hours on Sundays and Bank Holidays unless agreed in writing with the Local Planning Authority. Reason: In order to protect amenity of the area.
8.The applicant should ensure that any mechanical plant and associated ducting is suitably treated/isolated and installed to ensure that the noise and vibration from the hereby permitted use to ensure that the occupiers of neighbouring residential properties are provided with reasonable resting/sleeping conditions with reference to British Standard BS8233: 2014 - Guidance on Sound Insulation and Noise Reduction for buildings - Code of practice. Reason: In order to protect the amenity of residents from noise and vibration from the commercial units.
9.No plant or machinery shall be installed unless it meets, or mitigation is employed, to meet the following standard: The Rating Level (Lar, Tr) of the hereby permitted plant or machinery shall be at least 10dB below the prevailing background noise level (LA90, T). The measurement position, assessment and definitions shall be made according to BS4142:2014 + A1:2019 "Methods for rating and assessing industrial and commercial sound."� The equipment shall be maintained thereafter to the satisfaction of the Local Planning Authority, and the use hereby permitted must cease during any period that this condition is not complied with.� Reason:�� To protect the amenity of noise sensitive premises from noise from mechanical plant.�
10.Statement Required by Article 35(2) of the Town and Country Planning (Development Management) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraph 38 of the National Planning Policy Framework.
