1.The proposed development by reason of the inadequate access and servicing arrangements fails to provide a sufficiently high quality of development. The length and narrowness of the access would not adequately serve the needs of future occupiers in terms of accessibility and would lead to conflict between pedestrians and vehicles and does not demonstrably make adequate provision for the servicing of the site, including access for emergency vehicles or appropriate provision for refuse/recycling bin drop off due to the distance between the site and Oliver Road and the terrain of the road, contrary to Policy 7, 10, 24, 26 and Policies 35 of the Havering Local Plan.
2.Insufficient information has been submitted to determine the impact on the trees within the site. The submission fails to accurately demonstrate the details of trees proposed to be retained within the site and explain how they would be impacted by the proposed development in the current and future context of the site's use, contrary to Policies 10 and 27 of the Havering Local Plan.
3.The proposed development, by reason of the poor quality access arrangements for future occupiers of the development as well as the lack of sufficient information to demonstrate that the development will provide adequate levels of amenity, including adequate provision of internal daylight to the properties and daylight to the property's rear amenity space, would not give rise to a suitably high quality living environment for future occupiers of the development, contrary to Policies 7 and 10 of the Havering Local Plan.
4.Insufficient information, including a completed version of the Small Sites Metric and a habitat map, to demonstrate that Biodiversity Net Gain can be delivered to meet mandatory BNG requirements, contrary to Schedule 7A (Biodiversity Gain in England) of the Town and Country Planning Act 1990.
5.Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: Consideration was given to seeking amendments, but given conflict with adopted planning policy, notification of intended refusal and the reason(s) for it was given to the agent via email on 6th September 2024.
6.In the event that this application is allowed through the appeals process, the proposals would be liable for the following CIL contributions: Havering CIL (MCIL2) contribution of £22,125 (x £25 per sqm). Mayoral CIL (HCIL) contribution of £4,425 (x £125 per sqm) Each contribution would be subject to indexation.
