| 1. | The development hereby permitted shall not be carried out otherwise than in complete accordance with the approved plans, particulars and specifications.
Reason:-
The Local Planning Authority consider it essential that the whole of the development is carried out and that no departure whatsoever is made from the details approved, since the development would not necessarily be acceptable if partly carried out or carried out differently in any degree from the details submitted. Also, in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 2. | The premises shall not be used for the purposes hereby permitted other than between the hours of 07:00 and 18:30 on Mondays to Fridays; 08:00 and 18:00 on Saturdays and 08:00 and 17:00 on Sundays, Bank or Public holidays without the prior approval of the Local Planning Authority.
Reason:-
To enable the Local Planning Authority to retain control in the interests of amenity, and in order that the development accords with Development Control Policies Development Plan Document Policy DC61. |
| 3. | Provision shall be made for the enclosed storage of refuse and recycling awaiting collection within the rear yard and such facilities shall be retained for the lifetime of the development.
Reason:-
In the interests of amenity of occupiers of the development and also the visual amenity of the development and the locality generally, and in order that the development accords with the Development Control Policies Development Plan Document Policy DC61. |
| 4. | No additional plant or machinery shall be installed within the premises, other than in accordance with details that have been submitted to and approved in writing by the local planning authority. The plant or machinery shall be designed to achieve the following standard. Noise levels expressed as the equivalent continuous sound level LAeq (1 hour) when calculated at the boundary with the nearest noise sensitive premises shall not exceed LA90-10dB. The installation shall be carried out in accordance with the approved details and thereafter, the equipment shall be maintained and operated within design specifications whilst in operation.
Reason: To minimise the impact of the development on the surrounding area in the interests of residential amenity, and that the development accords with Development Control Policies Development Plan Document Policies DC55 and DC61. |
| 5. | The existing extraction equipment for the removal and dispersal of odours and odorous material from the premises shall be retained for use in connection with the A3 use hereby permitted. The extraction equipment shall be maintained and operated within design specifications during normal opening hours.
Reason:-
To protect the amenity of occupiers of nearby premises in accordance with Development Control Policies Development Plan Document Policy DC61. |
| 6. | This planning permission relates to the premises at 155 St. Marys Lane only and does not grant planning permission for the use of the public highway to the front for sitting out areas in connection with the change of use. Planning permission may be required for any external seating areas. |
| 7. | Statement Required by Article 35 (2) of the Town and Country Planning (Development Management Procedure) (England) Order 2015: No significant problems were identified during the consideration of the application, and therefore it has been determined in accordance with paragraphs 186-187 of the National Planning Policy Framework 2012. |
